The Food and Behaviour Research Terms & Conditions apply between you and Food and Behaviour Research ("FAB Research", “we”, "us" or “our”) and govern your and our respective rights and obligations.

The Terms and Conditions here stated constitute the agreement between you and us related to your FAB Research Associate Membership through the website, info.fabresearch.org. Please read these Terms fully.

1. The FAB Research Associate Membership                                

The Food and Behaviour Research Associate Membership (or otherwise referred to as “FAB Associate Membership” or “Associate Membership”) is a program offering its members a variety of digital benefits and services as set out in these Terms. For this, FAB Research collects a membership fee.

Through the act of signing up for an FAB Research Associate Membership, you explicitly request that we begin providing your Associate Membership within your 14-day cancellation period.

2. Associate Membership Benefits                        

FAB Research Associate Members have access to materials in the audio/visual library held on the website, info.fabresearch.org, including:
- Videos, webinars, podcasts, blogs
- PowerPoint presentations, factsheets, pdf downloads
- The most recent nutrition news and research, with exclusive summaries of key articles, educational monthly newsletters, blogs, and factsheets

Additionally, Associate Members have free access to FAB webinar events occurring during their active membership period.

While every effort will be made by FAB Research to deliver benefits here detailed, FAB Research reserves the right to remove any (and not limited to) the above content at any time and without warning or notice, including the cancellation of previously announced webinar and other live events.

Further, FAB Research reserves the right to provide additional services/content outside of the Associate Membership, whether free of charge or through a separate paid service.

The Associate Membership is an ongoing membership program and the range and frequency of benefits may differ or change over time. By entering this agreement, you accept the membership offering may vary in accordance with FAB Research’s stated objective of improving current knowledge and awareness of the effects of nutrition and diet on human behaviour, learning and mood. 3. Associate Membership usage                    

The Associate Membership and benefits are for your personal and non-commercial use only and may not be shared with individuals beyond your household. During your Associate Membership period we grant you limited, non-exclusive, non-transferable right to access FAB Research’s library of content and live events. No right, title or interest shall be transferred to you.

4. Associate Membership fees and duration of service                    

The current Associate Membership fees, membership benefits and duration of the membership are stated here. You will find details about your Associate Membership subscription in Settings.

The Associate Membership fee is non-refundable except where expressly stated in these Terms.

5. Billing                    

From the date of signing up to the Associate Membership you will be billed either on an annual or monthly basis (depending on your stated choice during the signup process). We will continue to bill you using the payment details you provided until you notify us that you want to discontinue your membership.

If your payment details become invalid or the charge is otherwise refused for any reason outside our control, you must provide us with new valid payment details within 30 days or your Associate Membership will be cancelled.

6. 14-day right of withdrawal or cooling off period                    

You may withdraw your payment for the Associate Membership within the first 14 days of signing up. If your account has not been accessed in this current membership period, we will refund this membership fee in full. Otherwise, we may issue you a partial refund based on your use of the Associate Membership benefits during this period.

You can withdraw within the 14-day period, by accessing your Billing Info within your account and cancelling your subscription under ‘Active Subscriptions settings’. Alternatively, you may also contact customer service. We must receive communication from you within the 14-day period in order to meet this obligation.

7. Cancellation (by you) and refunds                    

You may cancel your Associate Membership at any time by accessing your Billing Info within your account and cancelling your subscription under ‘Active Subscriptions settings’. Alternatively, you may also contact customer service. If your Associate Membership benefits have not been accessed within the current membership period, we will refund this membership fee in full. Where Associate Membership benefits have been accessed, you may be eligible for a partial refund of this membership fee based on benefits usage at our discretion.

No refund shall be made for Associate Memberships redeemed through a promotion or gift code.

8. Promotional and trial Associate Memberships                    

Periodically, we may offer trial or promotional Associate Memberships. Such Memberships are subject to these same Terms except as where otherwise stated in the promotional Associate Membership terms. If the event that trial or promotional Associate Members wish to end their Associate Membership (without becoming a regular paid Associate Member) the promotional Membership can be cancelled by accessing your Billing Info within your account and cancelling your subscription under ‘Active Subscriptions settings’. Alternatively, you may also contact customer service.

Promotional and trial Associate Membership eligibility is determined by and at the sole discretion of FAB Research. We reserve the right to revoke said promotion or trial and withhold Associate Membership benefits in the event that we determine you are no longer eligible.

9. Acceptance of Associate Membership                    

We reserve the right to accept or refuse your Associate Membership, to the extent permitted by applicable law.

10. No resale or transfer of Associate Membership (or benefits)                    

You may not sell, transfer or otherwise assign your Associate Membership, including any benefits and/or promotion codes, except where expressly stated in these Terms.

11. Age restriction                    

The Associate Membership is available to anyone at least aged 18 years or older. We will reject Associate Membership subscriptions (paid or promotional) where this condition is not met and terminate any existing Associate Membership in the event of becoming aware of its breach.

12. Termination                    

We may terminate your Associate Membership with 14 days’ notice. In such instances we will issue a partial refund of your paid Associate Membership fee based on the time remaining in your current membership period.

We may terminate your Associate Membership immediately by notice if we consider that:
i) your use of the Associate Membership materially breaches these Terms or any applicable law or
ii) you fraudulently use or misuse the Associate Membership. In this case we will not give any refund. We will inform you of the termination of your Associate Membership and your right to appeal.

You may terminate your Associate Membership at any time in accordance with Clause 7 [Cancellation (by you) and refunds].

13. Agreement Changes                    

We may change these Terms or the Associate Membership or any part of it, at any time: for legal or regulatory reasons; for security reasons; to enhance existing features or add additional features to the Associate Membership; to make reasonable technical adjustments to the Associate Membership; to reflect advancements in technology; and to ensure the ongoing operability of the Associate Membership.

In the event we make changes, we will inform you with due form and time about it and remind you of your rights. You will be free to not accept these changes and you will have the option to cancel your Associate Membership.

Regardless of any changes to these Terms or the Associate Membership, any increase in the applicable Associate Membership fee will not apply before the end of your current membership period.

If any change is found invalid or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions.

14. Events Beyond our Reasonable Control                    

We will not be held responsible for any delay or failure to comply with our obligations under these Terms if the delay or failure arises from any cause which is non foreseeable and beyond our reasonable control.

15. Applicable Laws                    

These conditions are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg (with the exception subject to the exclusion of its conflict of law provisions), and the application of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. If you are a consumer and have your habitual residence in the EU or the UK, you additionally enjoy the protection afforded to you by mandatory provisions of the law of your country of residence. We both agree to submit to the non-exclusive jurisdiction of the courts of the district of Luxembourg City, which means that you may bring a claim to enforce your consumer protection rights in connection with these Conditions of Use in Luxembourg, the UK or in the EU country in which you live. If you reside in the EU, the European Commission provides for an online dispute resolution platform, which you can access here: https://ec.europa.eu/consumers/odr.
